CONCERNING
STIPULATION OF TARIFF OF IMPORT DUTY ON IMPORT OF GOODS IN THE FRAMEWORK
OF EARLY HARVEST PACKAGE (EHP) FOR ASEAN-CHINA FREE TRADE AREA (AC-FTA)

THE MINISTER OF FINANCE,

Considering:

a. that, imposition of tariff of import duty in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA) as set forth in decree of The Minister of Finance No. 355/KMK.01/2004 is in Accordance with Attachment to the Said Decree for 2004-2006;
b. that, to create of legal framework to ensure certainty for treatment of import duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA), it is necessary to confirm that stipulation of tariff of import duty for 2006 as set forth in the decree of the Minister of finance No. 355/KMK.01/2004 remains applicable since january 1, 2007;
c. that, based on the considerations as intended in paragraph a and b, it is necessary to stipulate regulation of the Minister of Finance on stipulation oof tariff of early duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA);

In view of:

1. Law No. 10/1995 on customs (statue book of 1995 No. 75, supplement of statue book No. 3612) as has already been amended by law No. 17/2006 (statue book of 2006 No. 93, supplement of statue book No. 4661);
2. Presidential decree No. 48/2004 on Ratification of Framework Agrement on Comprehensive Economic Cooperation Between Association of South East Nations and the Peoples Republic of China (statue book of 2004 No. 50);
3. Presidential Decree No. 20/P/2005;
4. Decree of the Minister of Finance No. 10/KMK.05/1997 on Customs Manifest as has already been amended several times and latest by regulation of the Minister of Finance No. 48/PMK.04/2005;
5. Regulation of the Minister of Finance No. 56/PMK.010/2005 on Program of Reduction/ Elimination of Tariff of Import Duty in the Framework of Normal Track of Asean-China Free Trade Area (AC-FTA);
6. Decree of the Minister of Finance No. 355/KMK.01/2004 on stipulation on Tariff of Import Duty on Import of Goods in The Framework of Early Harvest Package (EHP) for Asean-China Free Trade Area (AC-FTA);
7. Regulation of Minister of Finance No. 110/PMK.010/2006 on Stipulation of System of Classification of Goods and Imposition of Tariff of Import Duty on Import Goods;

HAS DECIDED:

REGULATION OF THE MINISTER OF FINANCE ON STIPULATION OF TARIFF OF IMPORT DUTY ON IMPORT OF GOODS IN THE FRAMEWORK OF EARLY HARVEST PACKAGE (EHP) FOR ASEAN-CHINA FREE TRADE AREA (AC-FTA)

Article 1

Stipulating tariff of import duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA) for 2006 as set forth in attachment to decree of the minister of finance No. 355/KMK.01/2004 on stipulation of tariff of import duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA) to become tariff of import duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA) for 2006 as set forth in attachment to decree of the minister of finance No. 355/KMK.01/2004 on stipulation of tariff of import duty on import of goods in the framework of early harvest package (EHP) for Asean-China free trade area (AC-FTA) since January 1,2007.

Article 2

The director general of customs and excise is instructed to implement the provision of this regulation.

Article 3

This regulation comes into effect as from the date it is stipulated and is retroactive since January 1, 2007.

For public notice, this regulation is published in the state gazette of the republic of Indonesia.
